Terms of Service for Chat Film

By creating an account you agree to these Terms. If you do not agree, do not use Chat Film.

Chat Film is operated by Chat Film (ABN 47 271 351 041), Sheidow Park SA 5158, Australia.

1. Who may use Chat Film

You must be at least 13 years old. By using Chat Film you confirm that you are, and that you have never been banned from the service.

We do not ask for your date of birth — we would rather not hold age data than collect it. The age requirement is a condition you accept when you create an account, and we may remove any account we learn belongs to someone under 13.

If you are a minor in your jurisdiction, you confirm your parent or guardian has reviewed and agreed to these Terms.

2. Your account

Give accurate information when you register.
You are responsible for keeping your password secure, and for everything that happens under your account.
Tell us at support@chat-film.com if you suspect unauthorised access.
One person per account. Do not share, sell or transfer your account.

3. Your content

You keep ownership of everything you post.

You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display your content solely to operate Chat Film — for example, storing a photo so your friends can see it. This licence ends when you delete the content or your account, except where it has already been shared with others, or where we must retain it for legal or safety reasons (see §5).

We claim no ownership of your content and will not use it for advertising or sell it to third parties.

You confirm that you own or have the rights to what you post, and that it does not infringe anyone else’s rights.

4. Rules of conduct

There is zero tolerance for objectionable content or abusive users.

Do not post, send, or do any of the following:

Sexual content involving minors. This is reported to the authorities.
Harassment, bullying, threats, or stalking
Hate speech or attacks based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability or serious disease
Sexually explicit or pornographic material
Graphic violence, or content promoting self-harm or suicide
Spam, scams, phishing, or fraud
Impersonating any person or organisation
Illegal content, or content promoting illegal activity
Malware, or attempts to hack, overload, scrape or reverse-engineer Chat Film
Circumventing blocking, reporting, or parental controls
Automated or bulk account creation

5. Moderation, reporting, and enforcement

Reporting. Every post, message, and user can be reported from inside the app. Choose a reason (spam, harassment, hate, nudity, violence, scam, or other) and add detail.

Blocking. You can block any user at any time. Blocking is immediate and mutual in effect: you disappear from each other’s posts and messages, your friendship and shared chat are removed, and neither of you can contact the other.

Our commitment. We review reports of objectionable content and act on them within 24 hours. We may remove content, warn, suspend, or permanently ban accounts, and we may report unlawful content to the authorities.

We may act without notice where the risk is serious. If your account is removed you may appeal to support@chat-film.com.

We are not obliged to pre-screen content, but we may review and remove anything that breaks these Terms.

6. Parental controls

Chat Film offers an optional PIN-protected daily time limit and downtime window. They are off unless someone sets them up, and are intended for a parent or guardian setting up the app for a younger person.

Once set, they are stored against the account and enforced on our servers, so they follow the account to a new device and are not cleared by reinstalling the app.

They remain an aid, not a guarantee. Someone determined to avoid them could use a different account or a device without Chat Film on it. They do not filter or moderate the content a user sees, and they are not a substitute for parental supervision.

7. Privacy

Our Privacy Policy explains how we handle your information and forms part of these Terms. You can also read it inside the app, under Settings → About.

8. Ending your account

You may delete your account at any time: Settings → Account Settings → Delete Account. This is permanent.

We may suspend or terminate your account if you break these Terms, if we are legally required to, or if we discontinue Chat Film.

Sections 3 (licence, as limited), 9, 10, 11 and 12 survive termination.

9. Disclaimers

Chat Film is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, secure or error-free, that messages will always be delivered, or that content will always be available. Keep your own copies of anything you cannot afford to lose.

We are not responsible for content posted by other users.

Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth) or any other law that cannot lawfully be excluded. Where our liability for breach of such a guarantee can be limited, it is limited to resupplying the service, or paying the cost of having it resupplied.

10. Limitation of liability

To the fullest extent permitted by law, Chat Film (ABN 47 271 351 041) is not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, or goodwill.

Our total liability for any claim relating to Chat Film is limited to the greater of the amount you paid us in the past 12 months, or AUD 100.

Some jurisdictions do not allow these exclusions, so they may not apply to you. Nothing here excludes liability that cannot lawfully be excluded — including, in Australia, the consumer guarantees described in §9.

11. Indemnity

You agree to indemnify Chat Film (ABN 47 271 351 041) against claims arising from your content, your use of Chat Film, or your breach of these Terms or of anyone’s rights.

12. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-laws rules. Disputes go to the courts of New South Wales, unless your local consumer law gives you the right to bring proceedings elsewhere.

Before starting proceedings, please write to support@chat-film.com — most complaints are resolved faster that way.

13. App Store terms

Chat Film is distributed through the Apple App Store and Google Play, and their terms also apply.

Apple. These Terms are between you and Chat Film (ABN 47 271 351 041), not Apple. Apple has no obligation to provide support or maintenance. If Chat Film fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple is not responsible for addressing claims relating to Chat Film, including product liability, legal-compliance, and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. General

Changes. We may update these Terms and will change the date above, giving in-app notice of material changes. Continued use means acceptance.
Severability. If a provision is unenforceable, the rest stands.
No waiver. Not enforcing a right does not waive it.
Entire agreement. These Terms and the Privacy Policy are the whole agreement between us.
Assignment. You may not assign these Terms; we may, on notice.
